General contracting procedure

The contracting procedure can only be carried out in Spanish. If it can be carried out in another language, this will be indicated before starting the contracting procedure.

For the contract for the purchase of products in our store to be valid, the information provided by the user to place the order must be accurate, complete, and up to date at all times. Failure to do so constitutes a breach of these terms, which may result in the dissolution of the contract with David Montero Sánchez.

Purchase validation

Once the purchase has been made, Billy Paper will immediately send the user an order confirmation by email. If the customer does not agree with the details on this confirmation, they may request that these be modified or that the order be cancelled.

In any case, notification of cancellation or modification must be made within seven business days of the order confirmation, via email to hola@billypaper.com, and only if the order has not yet been shipped.

Prices

The prices applicable to each product are those indicated on the website on the date of the order. Prices are expressed in euros (€) and include the applicable VAT (Value Added Tax) in Spain.

However, in accordance with Law 37/1992, of December 28, on Value Added Tax, the transaction may be exempt from or not subject to this tax depending on the buyer's country of residence and the capacity in which they are acting (business/professional or private individual).

Consequently, in some cases the final price of the order may differ from that shown on the website.

The invoice is issued upon shipment and can be accessed and downloaded from the user account, in addition to being sent in PDF format in the shipping confirmation email.

Validity of prices and offers

The products offered on the website, and their prices, will be available for purchase for as long as they are displayed and can be viewed on the website.

Users are asked to access updated versions of the website to avoid pricing errors. In any case, orders in process will retain their conditions for 7 days from the time they were placed.

Payment methods

The user/buyer agrees to pay for the products purchased at Billy Paper using the accepted payment methods, and for any additional amount (including taxes).

Billy Paper accepts the following payment methods:

  4. PayPal
  5. Amazon Pay
  6. Bizum

Once the purchase has been made, a confirmation of the order placed will be sent to the email address provided, which will serve as proof of the transaction ("Order Confirmation"), along with a link to these general terms and conditions of purchase, as well as the returns policy.

The order confirmation and its proof of purchase will not be valid as an invoice, which will be sent when the order ships.

Delivery conditions

All items in our store indicate stock availability when selecting their attributes. If all items in the order are in stock and the order is confirmed and paid for before 2:00 PM, we will do everything possible to ship it that same day.

It will be delivered within 48/72 business hours from the time we confirm it has shipped. If the order is confirmed after 2:00 PM, it will ship the next business day.

If an item is out of stock, we will inform you at all times of the estimated date provided by each supplier, to which we are committed.

Should there be any issue with delivery times, our customer service team will inform you, always offering the best solution and the option to cancel the order if you wish.

Cancellations, Returns, and Withdrawal

Cancelling an order

An order can only be cancelled if it has not yet been shipped. To cancel an order, please send an email to hola@billypaper.com providing the order reference you wish to cancel.

The refund will be made using the same payment method chosen when placing the order.

Returns and withdrawal. Right of Withdrawal

Withdrawal is the right of a consumer to return a good to the retailer within a legal period, without having to state or give any explanation, and without incurring any penalty.

Under current regulations, the consumer and user has the right to WITHDRAW from the contract within a maximum period of 14 calendar days, without needing to state a reason and without incurring any cost, except as set out in articles 107.2 and 108 of Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users.

Exemption from liability

Due to their nature, our products do not include support or assistance services for their use, and Billy Paper is exempt from any responsibility to provide such a service, although we always try to offer support for any questions where possible.

Billy Paper assumes no responsibility arising from the misuse of products purchased on our site, and more specifically, Billy Paper is exempt from any liability for any risk or loss, whether personal or of any other kind, that may occur as a direct or indirect result of the misuse of any product purchased on this website. This does not apply to a manufacturing defect in the product, in which case Billy Paper is obliged to resolve the issue by refunding the amount or sending a new product.

Billy Paper assumes no responsibility regarding the decision to purchase any of the products acquired, this decision being entirely at the customer's own discretion and responsibility.

This website also contains links to other websites that are not operated by Billy Paper (hereinafter, the "Related Sites"). We have no control over the Related Sites and therefore accept no responsibility for them, nor for any loss or damage that may arise from your use of them. Your use of the Related Sites will be subject to the terms and conditions of use and service contained on each of those websites.

After-sales service and warranties

Due to the nature of the items we sell, we do not have an after-sales service as such, although we try to resolve any questions you may have.

All products carry the two-year legal warranty. In the event of a defect, the full amount paid will be refunded.

Intellectual and industrial property

These General Terms and Conditions do not transfer any intellectual or industrial property rights over David Montero Sánchez's website or any of its component elements. Users are expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available to the public, extracting, reusing, forwarding, or using in any way, by any means or procedure, any of them, except in cases where this is legally permitted or authorized by the holder of the corresponding rights.

The user acknowledges and accepts that the entire website, including without limitation the texts, articles, images, designs, software, content (including its structure, selection, arrangement, and presentation), audiovisual material, and graphics, is protected by Billy Paper's trademarks, copyrights, and other legitimate registered rights, in accordance with the international treaties to which Spain is a party and other property rights and laws of Spain.

Changes to the terms of use

Billy Paper reserves the right to modify, at any time, the presentation and configuration of the website, as well as these General Terms and Conditions.

For this reason, Billy Paper recommends that all users read them carefully each time they access the website. Anyone contracting any of the services offered on this website will always have access to the General Terms and Conditions in a visible location, freely accessible for any queries they wish to make.

Should any clause of these General Terms and Conditions be declared void, the remaining clauses will remain in force and will be interpreted taking into account the intent of the parties and the purpose of these General Terms and Conditions.

Billy Paper may choose not to exercise any of the rights and powers granted in this document, which will under no circumstances imply a waiver of them, except by express acknowledgment by Billy Paper or the statute of limitations applicable to the action in question.

Applicable law and jurisdiction

These Terms of Use are governed by Spanish law. These Terms of Use are subject to the provisions of Law 7/1998, of April 13, on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and other supplementary laws, Law 7/1996, of January 15, on Retail Trade Regulation, and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.

In accordance with Article 29 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, contracts concluded electronically involving a consumer as a party shall be presumed to have been concluded in the place where the consumer has their habitual residence. Therefore, in the event of a dispute arising from these general terms and conditions, and for the resolution of any conflicts, the parties submit to the courts and tribunals of the User's domicile.

Likewise, electronic contracts between business owners or professionals, in the absence of an agreement between the parties, shall be presumed to have been concluded in the place where the service provider is established.
